Florida DEP Workshops on Statewide ERP Permit Rule

The Florida Department of Environmental Protection (FDEP), Division of Water Resource Management, announced additional public workshops to discuss the statewide environmental resource permit (ERP) rulemaking effort.

Pursuant to Section 373.4131, F.S., as created by House Bill 7003, FDEP, in coordination with the five Water Management Districts, is required to develop statewide ERP rules governing the construction, alteration, operation, maintenance, repair, abandonment, and removal of stormwater management systems, dams, impoundments, reservoirs, appurtenant works or works, or combinations thereof, to implement Part IV of Chapter 373, F.S.  According to FDEP, this rulemaking will rely primarily upon existing rules of FDEP and the Water Management Districts, revised as necessary to achieve a more consistent, effective, and streamlined approach to implement the ERP program.

Comments will be solicited to amend Chapter 62-330, F.A.C., an existing rule of FDEP that currently incorporates by reference the rules of the Water Management Districts used by FDEP to implement its responsibilities under the ERP program. The chapter will be substantially revised to become the statewide environmental resource permitting rules.

A workshop was previously held on July 26, 2012.  A copy of the Powerpoint Presentation is available here.  Building on the July 26th workshop, additional workshops were announced and the general public may participate either through the webinars or in person.
